Hitchr is an online marketplace that connects trailer owners ("Owners") with individuals seeking to rent trailers ("Renters").
Hitchr facilitates listings, reservations, payments, and communication between users but is not a party to the rental agreement between an Owner and a Renter unless expressly stated otherwise.

3. Eligibility
To use Hitchr, you must:
* Be at least 18 years old.
* Have the legal capacity to enter into binding agreements.
* Provide accurate and complete information.
* Maintain the security of your account credentials.
You are responsible for all activity that occurs under your account.

4. User Accounts
Users agree to:
* Maintain accurate account information.
* Keep login credentials confidential.
* Notify Hitchr immediately of unauthorized account access.
* Not create multiple accounts to evade restrictions or suspensions.
Hitchr may suspend or terminate accounts that violate these Terms.

5. Trailer Listings
Owners are responsible for ensuring that trailer listings are:
* Accurate
* Complete
* Lawful
* Up to date
Owners represent that they have the legal authority to rent the listed trailer.
Hitchr does not independently verify the condition, ownership, or suitability of listed trailers.

6. Rental Bookings
By confirming a reservation:
* The Renter agrees to rent the trailer under the listing terms.
* The Owner agrees to make the trailer available as described.
Both parties agree to cooperate in scheduling pickup and return.
Additional rental agreements or inspection forms may apply.

7. Payments
Payments are processed through third-party payment processors.
By submitting payment information, you authorize Hitchr and its payment processor to charge the applicable fees.
Platform fees, taxes, deposits, and other charges may be disclosed before checkout.
Refunds are subject to the applicable cancellation policy.

8. Cancellations and Refunds
Cancellation policies may vary depending on the listing.
Where applicable:
* Refund eligibility depends on the timing of cancellation.
* Platform fees may be non-refundable.
* Hitchr may issue refunds or credits in its sole discretion to resolve disputes or correct errors.

9. User Conduct
Users agree not to:
* Violate any law or regulation.
* Provide false information.
* Harass, threaten, or abuse other users.
* Circumvent the Hitchr platform to avoid applicable fees.
* Use the Services for fraudulent purposes.
* Attempt unauthorized access to Hitchr systems.
* Upload malicious software or harmful code.
* Interfere with the operation of the Services.

10. Communications
Hitchr may send transactional communications, including:
* Verification codes
* Booking confirmations
* Rental reminders
* Payment notifications
* Customer support communications
* Messages between Owners and Renters using temporary proxy phone numbers
Users consent to receive these communications when creating an account or completing a rental.
Message frequency varies.
Message and data rates may apply.
Users may opt out of SMS communications by replying STOP where applicable. Opting out of certain transactional messages may limit the ability to use portions of the Services.

11. Temporary Proxy Messaging
To protect user privacy, Hitchr may provide temporary phone numbers that allow Owners and Renters to communicate without revealing personal phone numbers.
Users agree:
* Not to misuse the messaging system.
* Not to attempt to identify or contact another user outside the platform without permission.
* That communications may be logged for operational, security, fraud prevention, legal, or dispute resolution purposes.

12. User Content
Users retain ownership of content they submit to Hitchr.
By submitting content, users grant Hitchr a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and use such content as necessary to operate and improve the Services.
Users represent that they have the rights necessary to provide such content.

13. Ratings and Reviews
Owners and Renters may leave reviews following completed rentals.
Reviews must be truthful and based on actual experiences.
Hitchr reserves the right to remove reviews that violate these Terms or applicable law.

14. Safety
Users are responsible for complying with all applicable laws regarding trailer operation, towing, licensing, insurance, and safety.
Hitchr does not guarantee:
* The condition of trailers.
* The qualifications of users.
* The safety of any rental.
Users assume responsibility for their own actions.

15. Insurance and Liability
Owners are responsible for maintaining any insurance required by law or desired for their trailers.
Renters are responsible for any damage or loss they cause during the rental period, subject to applicable agreements and law.
Hitchr does not provide insurance unless expressly stated.

16. Disputes Between Users
While Hitchr may assist in resolving disputes, users acknowledge that rental agreements are primarily between the Owner and the Renter.
Hitchr may investigate disputes and take actions including:
* Suspending accounts
* Removing listings
* Issuing refunds or credits where appropriate
* Requesting supporting documentation
Hitchr is not obligated to resolve every dispute or act as an arbitrator.

# 17. Intellectual Property
The Hitchr name, logos, trademarks, software, and content are owned by Hitchr or its licensors.
Users may not copy, reproduce, modify, distribute, or create derivative works without prior written permission.

18. Disclaimer of Warranties
The Services are provided "AS IS" and "AS AVAILABLE."
To the maximum extent permitted by law, Hitchr disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Hitchr does not guarantee uninterrupted, error-free, or secure operation of the Services.

19. Limitation of Liability
To the fullest extent permitted by law, Hitchr, its officers, employees, affiliates, contractors, and agents shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or relating to the Services.
Where permitted by law, Hitchr's total liability for any claim arising out of or relating to the Services shall not exceed the greater of:
* The total platform fees paid by the claimant to Hitchr during the twelve (12) months preceding the claim; or
* One hundred U.S. dollars (US $100).
Some jurisdictions do not allow certain limitations of liability, so portions of this section may not apply.

Users agree to defend, indemnify, and hold harmless Hitchr and its affiliates from any claims, damages, liabilities, losses, costs, and expenses arising from:

21. Suspension and Termination

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law principles.
